Yesterday (Feb 29) several media outlets reported that incarcerated rapper Max B had been denied a last ditch appeal and would not be eligible for parole until 2042. People within Max’s camp are refuting those reports, telling AllHipHop that the Harlem rapper still has a few months before that determination will be made.

The CEO of Max’s current label Amalgam Digital, DJ Next, said,“We will have the official word on Max B’s appeal in April.”

Max also reportedly sent in a statement regarding the reports of his denied appeal saying, “This was just a test from God. A battle cry..a call to arms. I’m bullet proof. And I’m coming out on my grown man sh#t.”

Max, born Charlie Wingate, has been in a New Jersey prison since 2009 after he was convicted for his role in a 2006 robbery-homicide where David Taylor was killed. Wingate, who denies his involvement in the incident, was convicted of nine of 11 counts of conspiracy, murder and robbery charges and given a 75-year-sentence. Authorities allege Max sent his ex-girlfriend and stepbrother to rob two men at a New Jersey Holiday Inn. During the robbery, David Taylor was shot execution style, and later died.

Max filed for the appeal last year and is hopeful that he would be exonerated of all charges.
