The family of Trayvon Martin filed paperwork against the Retreat at Twin Lakes homeowners association, claiming monetary damages for the shooting death of the teenager, reports the Orlando Sentinel.
Martin’s mother, Sybrina Fulton, is named on the court documents filed last week by Travelers Casualty and Surety Company of America. The high school student was staying at the Retreat at Twin Lakes home of his father’s girlfriend, when he was shot dead by George Zimmerman. The former neighborhood watch captain alleges that he believed Martin to be suspicious, and was unaware that he was staying in the neighborhood.
According to the filing, the insurer is seeking further clarification of its liability in Martins death, and requests that a federal judge remove Travelers from financial responsibility. Travelers points out that the company “is in doubt of its rights,” and wants a “declaration of its rights and obligations with respect to the claim,” made by Fulton. The company cites a clause in its policy with the homeowners association outlining that the insurer “shall not be liable to make any payment,” occurring as a result of “bodily injury, sickness, mental anguish, emotional distress, disease or death of any person,” as evidence in the claim.
While the amount of Fulton’s claim has yet to be revealed, it “exceeds the sum of $75,000.”
Martin family lawyer, Benjamin Crump, revealed that his clients are looking into claims with “all the insurance companies that might be applicable.” Paperwork revealed by the Florida Attorney General’s office shows that Fulton filed additional claims with Florida Bureau of Victim Compensation for emergency crime-victim assistance, which was approved on March 29.
“It’s our job, as lawyers, to make sure that we protect our client’s interest,” said Crump, who also stated that the Martin family is filing claims against “entities that we believe are also accountable,” in addition to seeking justice for Martin “in the criminal courts.”
Zimmerman is currently free after posting $1 million bond, and will head to trial either later in the year, or early 2013.
