One Man Dead, Several Injured After Shootout With Police Leaves Man Shot 21 Times

Tuesday, August 10th, 2010

A community is recovering after a shootout with police left one man dead and another in the hospital after being shot 21 times.

According to published reports, police were responding to call about a fight between Luis Soto and Angel Alvarez, once police arrived on the scene is when one source states ‘all hell broke loose.'

Police state that Alavarez drew a weapon and fired four shots before being riddled with 21 bullets after police fired 47 shots.

In the aftermath, victim Soto was left dead after being shot in the chest by what ballistic evidence confirms was a bullet of a police officer.

Plainclothes NYPD Officer Michael Tedeschi, was hit in the chest by another cop's bullet, but survived thanks to his bulletproof vest.

Another cop was grazed in the hand and 3 civilians also suffered minor gunshot wounds.

Ballistic evidence confirms that the 3 civilians were also hit by police fire.

"We have no reason at this juncture to believe that they were involved in any wrongdoing. They just happened to be there," Police Commissioner Raymond Kelly told the New York Daily News. “Because of that, and the number of shots, this is going to be a shooting where the tactics are taken a hard look at.”

Although police are calling the case justified, witnesses state that it is just another case of police brutality.

"They were fist-fighting. I heard one fired shot before the police fired. When the first shot let off, Angel was still fist-fighting," Shariff Spencer told the New York Daily News."Police gunned down both of them. Never one time did you hear, 'Freeze,' did you hear, 'Stop.' Not 'NYPD.' Not nothing. All you heard was shots.”

Man Sues Restaurant After Finding Condom In Soup

Tuesday, August 10th, 2010

A Mission Viejo, California man will have his day in court now that he's suing a local restaurant after finding a condom in his soup.

51-year-old Philip Hodousek says he was eating French onion soup at a Claim Jumper restaurant in Orange County back in April of 2009 when he began to chew on what he believed was a hard piece of cheese.

Hodousek says when he could not swallow it he pulled the object out of his mouth and discovered that it was a condom.

A manager for the restaurant insisted that it was part of a rubber glove used for preparing the food but the man claimed otherwise and snapped a picture of the item before wrapping it in a napkin and taking it home.

When the condom was taken into a lab for testing, evidence of female DNA was found.

Claim Jumper also says they tested their employees and provided results to the family but according to his attorney Eric Traut, the family has yet to receive the information.

Last July, Hodousek admitted to owing the state and federal governments nearly $300,000 in back taxes and penalties, but said his debt and the restaurant incident are unrelated.

Attorney Traut says the man and his family would like their names cleared of any wrongdoing.

The case heads to trial Monday August 16th.

Four Men May Have Drowned After Joke Gone Too Far

Tuesday, August 10th, 2010

A rescue team is searching for four missing men who may have gone overboard on a boat during a prank gone awry.

The men are feared drowned during a boating trip, leaving five young children adrift on the boat in the 87-square-mile American Falls reservoir Sunday evening, authorities said
The children told marine patrol deputies that one of the men was standing near the edge of the boat when another one thought it would be funny to push him overboard, Power County Sheriff Jim Jeffries said.

"But apparently, he couldn't swim, so he was immediately in distress, The second man jumped in, and so then there were two of them in distress in the water, so the third jumped in and there were three in distress."

The children in the boat were between the ages of 2 and 9. One found a cell phone and called 911 after the men began struggling in the water.

The last adult on the boat managed to grab a life jacket before jumping in to try to save the other three, Jeffries said, but he wasn't wearing it. The water was muddy, and visibility was low, Jeffries said.

"The water's about 45 feet deep, and it's hard to see . You can see your hand, and that's about it. There's a lot of trees and rebar sticking up in the bottom of the water, and the divers are getting hung up in those sticks and things. It's a slow, tedious process."

A rescue team is still looking for the men.
