Those rejoicing over the reports that Bobby Shmurda’s gun charge was thrown out may just want to grab their “Free Shmurda” shirts from the dry cleaners. XXL has learned that Brooklyn District Attorney office dismissed the June 2014 case due to a legal technicality. It’s a procedural step to incorporate the charge into the Special Narcotics’ case where, if convicted, Shmurda (real name Ackquille Pollard) could face 25 years in jail.

Special Narcotics Prosecutor’s Office spokeswoman Kait Cornell explained that contrary to earlier reports, it was Bobby Shmurda’s gun charge from a June 2014 search and seizure that landed him in hot water. Not the much publicized Brooklyn barbershop incident where the 20-year-old rapper allegedly opened fire into a crowd of people.

Shmurda is due out in court later today, January 29, and will be represented by Kenneth J. Montgomery, Esq. of KJM PLLC instead of Howard Greenberg, who has been doing all the talking for him up unto this point.

Shmurda and his GS9 crew still face 70 charges, with the most serious accusations being murder, conspiracy and gun possession. The “Hot N***a” rapper is still residing in Manhattan Detention Complex on a $2 million bail where he has been lamping since December 2014.
