A Bronx judge has decided against summons issued to a man for wearing saggy pants.

Julio Martinez, was given his summons for disorderly conduct on April 20 of last year because his pants were down below hit buttocks, and exposed his underwear. The summons also added that the saggy pants had potential to expose a private part that was not welcomed.

Although Judge Ruben Franco did not agree with the citizen’s choice of style, he did say

“The Constitution still leaves some opportunity for people to be foolish if they so desire. While most of us may consider it distasteful, and indeed foolish, to wear one’s pants so low as to expose the underwear, people can dress as they please, wear anything, so long as they do not offend public order and decency.”

Yes, the summons were thrown out by the judge, but it does leave answered questions to think about. Will this become an occurring event? How low is too low when someone is sagging their pants? Do you feel that this act should be considered indecent exposure?
