The Associated Press is reporting that a Virginia judge has set an execution date for John Allen Muhammad, the mastermind of the 2002 sniper attacks that had Washington D.C. residents terrified for weeks.
Just last week, the attorney general’s office requested that Muhammad’s execution date be set for November 9, but Prince William County Circuit Judge Mary Grace O’Brian set his execution date for November 10.
Mr. Muhammad’s attorney, Jonathon Sheldon, said that O’Brian set the date back one day, a Tuesday, in the event that any appeals should be filed.
The date was confirmed on Monday during a conference call with the judge, the attorney general’s office and Mr. Sheldon.
Mr. Muhammed was sentenced to death for a three-week killing spree that left 10 people dead Washington D.C., Virginia and Maryland.
Mr. Muhammad did not act alone, as he toted a teen-age accomplice, Lee Boyd Malvo, around with him during his killing spree. Malvo is currently serving a life sentence for his involvement.
The deadly duo are also suspected of shootings in several other states including Louisiana and Alabama.
The gunman requested an appeal that was rejected last month, claiming prosecutors withheld pertinent evidence and are should have never let the Mr. Muhammad represent himself through the beginning stages of his trial because of his mental impairments.
Sheldon said his client plans to appeal to the Supreme Court and petition for clemency.
