Brittney Griner’s struggle just got more real. A judge has denied the WNBA star’s request that her 28-day marriage to a now pregnant Glory Johnson be annulled.

WNBA players Glory Johnson and Brittney Griner remain married for now after an Arizona judge on Wednesday rejected Griner’s request to annul the short-lived union, a member of Johnson’s camp confirms to PEOPLE exclusively.

The court decision effectively enforces Griner’s position as the couple’s breadwinner, since Johnson has taken a year off from the court to carry twins – a pregnancy that Johnson, who plays for the Tulsa Shock, announced on June 4, one day before Griner filed to annul the 28-day marriage.

But it also keeps open the door for Griner’s divorce request – filed along with the request for annulment – to proceed. In its exact language, the court found “no legal basis for annulment,” while stating “the case shall proceed on the Petition for Dissolution of Marriage with Minor Children.”

Needless to say Griner is moving forward with the divorce. As for Johnson, who Griner reportedly caught texting an ex-boyfriend, she’s happy with the decision

She told TMZ Sports, “Together we made life changing decisions which impacted our lives collectively, and we both should be held responsible for those decisions.”
