Attorney General Ken Cuccinelli could very well be setting himself up for failure in Virginia. The GOP gubernatorial candidate wants to outlaw oral sex between consenting adults, and the idea isn’t exactly catching on like wild fire.

The Republican candidate launched a new website spreading his viewpoints. Cuccinelli previously kicked off his fight requesting that the state reinstate a law against sodomy.

Virginia Attorney General Kenneth Cuccinelli has filed a petition with the 4th Circuit U.S. Court of Appeals in Richmond asking the full 15-judge court to reconsider a decision by a three-judge panel last month that overturned the state’s sodomy law.

The three-judge panel ruled 2-1 on March 12 that a section of Virginia’s “Crimes Against Nature” statute that outlaws sodomy between consenting adults, gay or straight, is unconstitutional based on a U.S. Supreme Court decision in 2003 known as Lawrence v. Texas.

A clerk with the 4th Circuit appeals court said a representative of the Virginia Attorney General’s office filed the petition on Cuccinelli’s behalf on March 26. The petition requests what is known as an en banc hearing before the full 15 judges to reconsider the earlier ruling by the three-judge panel.

 

Essentially, banning any and all kinds of mouth-to-genital pleasure will not only cut down on homosexual instances (his real issue), but protect children. The move will help further identify child predators nabbed under the Crimes Against Nature Law, parts of which were named unconstitutional by a 2003 Supreme Court ruling. Before, Crimes Against Nature included consenting couples (gay and straight) engaging in oral and anal intercourse in the privacy of their own homes.

According to his site, Vachildpredators.com, Cuccinelli outlines 90 predators prosecuted under the law that “could come off Virginia’s sex offender registry if the Virginia law used to protect children from predators is not upheld.”

While it is true that many sex offenders are charged under the Crimes Against Nature law, it is far from the only tool prosecutors have to punish child predators.

The law states, “If any person carnally knows in any manner any brute animal, or carnally knows any male or female person by the anus or by or with the mouth, or voluntarily submits to such carnal knowledge, he or she shall be guilty of a Class 6 felony…”

Democratic opponent Terry McAuliffe has called Cuccinelli’s attempt another showcase of his “divisive ideological agenda,” as a way of “ignoring” issues like the economy.

Just ahead of their recent debate, a large amount of voters weren’t sold in either direction. In May, Cuccinelli released fake polls showing himself five points behind McAuliffe, when the number was actually 12.

It’s not all stagnant for Cuccinelli when the it comes to the law. On Thursday (July 18) Richmond Commonwealth’s Attorney Mike Herring announced no plans to file charges against the him for amending state disclosure forms to include $13,000 worth of gifts he forgot to add to paperwork dating back to 2009.
