A so-called gangsta rapper from San Diego by the name of Tiny Doo is currently awaiting a judge’s decision on whether to be prosecuted on murder charges along with 14 others.

Fair enough, except Mr. Doo (real name Brandon Duncan) hasn’t even been tied in with the shootings in question. His connection to the crimes?

Releasing a hardened street album earlier this year by the name of No Safety.

The local media and prosecutors are trying to paint Doo as prominent artist who recorded songs with Lil Wayne and used his gang influence to “sell more albums.” Let’s be honest here for a second. Tiny Doo only has 1,159 Twitter followers (and hasn’t used the service since more than a year ago) and a quick Google search for his track with the Cash Money millionaire produces no positive results. Any attorney looking to earn a stripe by hanging a “famous rapper” out to dry needs to look a little further than Tiny Doo because there’s no elk head here. Maybe Jayo Felony is squatting in a house nearby?

10News asked Thomas Jefferson School of Law professor Alex Kreit and he seems to agree, citing a lot of holes in the case including the most obvious one in the constitutional right of with freedom of speech.

“Where does that end if that’s the definition of criminal liability? Is Martin Scorsese going to be prosecuted if he meets with mafia members for a movie for his next film?” he questioned. “The Constitution says it can’t be a crime to simply make gangster rap songs and hang out with people that are committing crimes. You have to have more involvement than that.”

In 2000, a state law was passed that allowed for gang members to be prosecuted if they benefitted from crimes committed by fellow gang members. In this instance, it would be Tiny Doo’s supposed spike in record sales. 10News reports he doesn’t even have a record.
