R&B star Jeremih is just days away from dropping his much-anticipated third studio effort, Late Nights: The Album, which includes the BeyoncĂ© besting smash hit, “Don’t Tell ‘Em” as the lead single. Unfortunately, it’s the same hit that has become the catalyst of federal lawsuit where a photographer and model are saying he straight jacked their artwork for initial single featuring YG and subsequent remixes featuring Ty Dolla $ign, French Montana and Pitbull.
In new documents obtained by The Jasmine Brand, photographer Alexander Flemming and model Louise Rams are claiming they never gave Def Jam and Universal Music permission to use their image.
Jeremih is also accused of the ultimate no-no by removing Flemming’s watermark from the picture when he used it for the single artwork.
Released on June 6, 2014, the record exploded on the Billboard Charts, peaking at No. 6 and eventually obtaining a double platinum certification from the RIAA. The song also took home this year’s iHeartRadio Music Award for Hip-Hop/R&B Song of the Year, infamously beating out a couple of nominated hits from the pop music legend.
Both Flemming and Rams are seeking compensatory damages from Jeremih and the label for the infringed photo. See the “Don’t Tell ‘Em” artwork on the next page.
