In what appears to be a move to get the Megaupload case tried on U.S. soil, the feds are pulling Swizz Beatz back into the case, although the matter was reportedly settled in January after attorneys for the file-sharing giant stated that the producer/rapper was never the company’s CEO as authorities claim. Now, the feds are hoping to exploit a loophole by pinning the executive tag on to the producer after Megaupload filed a motion to dismiss claiming lack of jurisdiction, according to a report from TorrentFreak.

Swizz, real name Kasseem Dean, was not named in the indictment of the “Mega Conspiracy” case brought by the Department of Justice that shut down Megaupload and several other such file-sharing sites. The defense team for founder Kim Dotcom‘s Megaupload argued that because they were not based in the U.S., the feds have no case. Grasping for straws, the feds are hoping to force Swizz Beatz’s hand and have him  cooperate with the investigation – which he has not done so thus far via his attorney.

U.S. Attorney Neil MacBride says that Beatz represented Megaupload last December in front of the United States Trade Representative, which essentially means the company can be tried in America. The feds are looking to serve Swizz with a summons which means by law he must come forward in the case. The details are murky however, as the feds’ filing on the matter still have little in the way of evidence that shows Swizz was an official member of the company’s executive board. If it gets proven that Swizz was on the board, this puts serious holes in Megaupload’s defense that they did not operate within American jurisdiction.
