A man in New York City died in a fatal attempt to use the bathroom, police confirmed Tuesday (Jan. 15).

The 31-year-old Bronx man was defecating between two cars when he lost his balance, fell, and was hit by the train.

He was pronounced dead at the scene of the accident, which occurred during the late afternoon rush hour at the 125th street station on Harlem’s East Side.

Minutes before the fatality, a 50-year-old homeless man was injured while trying to climb back onto the platform from the tracks, as a northbound train pulled into the station. He told authorities that he was intoxicated and couldn’t remember how he got on the tracks, and was taken to Harlem Hospital Center.

He suffered leg injuries but was not hit by the train.

In the last month three people have been killed by Subway trains in New York City. Last month, 58-year-old Ki Suk Han was pushed onto the tracks and struck by a No. 7 train, his killer has been charged in the death but asserted that he was the victim in the incident. Three weeks later, a woman committed a hate crime by shoving a man in front of a train believing that he was Muslim or Hindu.
